By booking an appointment with Realview Media (“Company,” “we,” “our”), you (“Client,” “you”) agree to the following terms and conditions:
1. OWNERSHIP & USAGE OF MEDIA
1.1 Company Rights – All images, videos, and media created by Realview Media remain the intellectual property of the Company.
1.2 Promotional Use – Realview Media retains the right to use any images and media captured for advertising and promotional purposes, including but not limited to professional portfolios, website content, and social media platforms.
1.3 License for Client Use – Clients are granted a limited, non-exclusive, non-transferable license to use the delivered media solely for marketing and promotional purposes related to the property photographed.
1.4 Community Amenity Photos – All community amenity photos are stock images captured by Realview Media and may be reused across multiple listings and agents.
2. SCHEDULING, CANCELLATIONS & RESCHEDULING
2.1 Cancellation Policy – Cancellations or reschedules made within 2 hours of the scheduled appointment will incur a $100 fee.
2.2 Onsite Cancellations/Reschedules – If a shoot is canceled or rescheduled after the photographer has arrived onsite, the $100 fee will automatically apply.
2.3 Company Right to Cancel – Realview Media reserves the right to cancel or reschedule a shoot if the onsite representative feels the environment is unsafe, poses a risk of harm, or if the conditions of the property are unsuitable for photography.
3. CLIENT RESPONSIBILITIES
3.1 Property Readiness – The Client is responsible for ensuring the property is prepared, cleaned, and staged before the scheduled shoot.
3.2 Access to Property – The Client must provide timely access to the property at the scheduled appointment time. Delays may reduce coverage or result in additional charges.
3.3 Accuracy of Representation – Client warrants that all information provided regarding the property is accurate. Realview Media is not responsible for any misrepresentation in advertising or marketing materials.
4. PAYMENT & FEES
4.1 Payment Terms – Payment is due before delivery of the final media unless otherwise agreed in writing.
4.2 Late Payments – Unpaid balances may result in late fees and suspension of services.
4.3 Travel Fees – Additional charges may apply for properties located outside Realview Media’s standard service area.
5. DELIVERY OF MEDIA
5.1 Turnaround Time – Standard turnaround time for photo delivery is next business day by 5pm unless otherwise agreed upon.
5.2 File Retention – Media files will be hosted and accessible for 90 days after delivery. Realview Media is not responsible for storing or archiving files beyond this period.
6. LIABILITY & LIMITATIONS
6.1 Limitation of Liability – Realview Media is not liable for property damage, loss of data, delays, or any indirect damages arising from services provided.
6.2 Force Majeure – Realview Media will not be held liable for delays or failure to perform due to circumstances beyond its control (including but not limited to weather, illness, equipment failure, natural disasters).
6.3 Indemnification – Client agrees to indemnify and hold Realview Media harmless from any claims, damages, or expenses arising out of the use of the images or conditions at the property.
7. GOVERNING LAW
This Agreement shall be governed by and construed under the laws of the State of Florida. Any disputes shall be resolved in the courts of Saint Johns, Florida.
8. ACCEPTANCE OF TERMS
By booking a service with Realview Media, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
